By accessing or using Check & Mate AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is operated by Check & Mate AI ("we," "us," or "our").
Check & Mate AI provides AI-powered sales agent technology for board game publishers. The Service includes AI persona management, automated phone outreach to retail stores, store intelligence, contact memory, campaign management, and analytics.
You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

The Service uses artificial intelligence to generate sales conversations. While we train our AI on proven sales methodologies, you acknowledge that AI-generated content may not always be perfect. You are responsible for reviewing AI persona configurations and ensuring they represent your brand accurately. All calls made through the Service are made on your behalf, and you accept responsibility for the content of those calls.
You agree to comply with all applicable telecommunications laws, including but not limited to the TCPA, FCC regulations, and state-level telemarketing laws. You are responsible for maintaining and honoring do-not-call lists. The Service provides tools to help with compliance, but ultimate responsibility lies with you as the account holder.
The Service includes a shared intelligence network where anonymized store data may be aggregated across publishers. By using the Service, you consent to contributing non-proprietary store insights to this network. Your proprietary data (game details, pricing, specific deal terms) is never shared. You may opt out of contributing to the shared network at any time.
The Service is offered on a monthly subscription basis. Pricing is as listed on our website at the time of purchase. We reserve the right to change pricing with 30 days' notice. Subscriptions auto-renew unless canceled before the renewal date. Refunds are handled on a case-by-case basis.
The Service, including its AI models, sales methodology, user interface, and underlying technology, is our intellectual property. Your game descriptions, store contacts, and other content you upload remain your intellectual property. By uploading content, you grant us a license to use it solely for providing the Service.
The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
Either party may terminate the agreement at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your data will be retained for 30 days, after which it will be permanently deleted unless you request an export.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
